LIMITED WARRANTY
New Assembled Products.
This product is covered by a limited warranty from Choitek LLC for the original purchaser that covers the product from defects in workmanship and materials for one (1) year from the date of receipt under the standard warranty, and three (3) years from the date of receipt under the extended warranty when buying new Choitek robots.
Factory Refurbished Products.
Choitek warrants to the original purchaser that factory refurbished Choitek robots are free from defects in material and workmanship for a period of ninety (90) days from the date of shipment to Customer. Choitek makes its best reasonable effort to restore Factory Refurbished Products to function as new, however factory refurbished status indicates Factory Refurbished Products are, in practice, second-hand goods. Factory Refurbished Products are more likely to have cosmetic shortcomings and more likely to have a shorter expected useful life, as compared to new assembled products.
Choitek's Obligation
The sole obligation of Choitek, at its option and without charge, is to repair, replace, or refund the original purchase price paid by Customer for, any Product or part, which Choitek manufactures and which Choitek agrees is defective, at its sole discretion. Repair parts or replacement Products may be new, remanufactured, or refurbished, at the sole discretion of Choitek. All returned parts or Products that are replaced become the property of Choitek.
Transfer of Other Warranties.
In the case of equipment and accessories not manufactured by Choitek, if a warranty is extended by the manufacturers thereof and transferable to Customer, Choitek shall transfer such warranty to Customer.
Exclusions
Damages through normal wear and tear, alteration, transport damage, misuse, neglect, accident, failure to follow operation or maintenance instructions, Customer’s negligent modification, disassembly or attempted repairs of the Product, service by anyone other than the authorized center, cosmetic shortcomings which do not influence Product function, sale or transfer of Product from the original purchaser to another person or legal entity, or acts of God are not included. Please note that Choitek robots are not intended for outdoor and/or all weather use, and that any such use will void the warranty.
Shipping
For approved warranty repairs of robots purchased directly from Choitek LLC (not through a reseller), shipping charges are covered to and from the original shipping location, as long as it is in the following list:
LIMITATION OF DAMAGES.
IN NO EVENT SHALL CHOITEK BE LIABLE TO CUSTOMER FOR ANY INDIRECT, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, INCIDENTAL OR SPECIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, PROFITS, OR DOWN-TIME (HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER THE BASIS OF LIABILITY IS BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), STATUTE OR ANY OTHER LEGAL THEORY), EVEN IF CHOITEK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CHOTIEK’S TOTAL LIABILITY TO CUSTOMER, FROM ALL CAUSES OF ACTION AND UNDER ALL THEORIES OF LIABILITY, WILL BE LIMITED TO THE AMOUNTS PAID TO CHOITEK BY CUSTOMER. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. THE REMEDIES UNDER THIS LIMITED WARRANTY ARE CUSTOMER’S SOLE AND EXCLUSIVE REMEDIES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO ALL CUSTOMERS.
Non-Severability
If any term of this limited warranty is held to be illegal or unenforceable by force of law, it will be excluded from the Limited Warranty and the legality or enforceability of the remaining terms shall not be affected.
Filing a Claim
During the warranty period and upon verification of defects, this product may be eligible for repair when Choitek support has been contacted. Warranty coverage extends to the official accessories that are used with each Choitek robot. Contact Choitek by email at [email protected] to file a warranty claim.
